Trial postponed in Centralia’s B Street homicide due to change in defense strategy

CHEHALIS – With just a week before his trial is set to begin, the former welder who fatally shot a houseguest inside his Centralia home has decided not to attempt to get an acquittal based on insanity, but on straight self defense.

Weston G. Miller, 30, and his lawyer went before a Lewis County Superior Court judge this morning to discuss how the change meant they need to postpone his trial.

“I hope the court would realize, it’s like starting over, basically from scratch,” Centralia attorney J.P. Enbody told the judge.

Enbody said it meant dealing with different experts, different criteria and different facts.

Judge Richard Brosey granted the delay but wasn’t happy.

Miller is charged with first-degree murder in the death of 43-year-old David Wayne Carson.

Police called the afternoon of March 13 to Miller’s house on B Street found Carson dead with two bullet wounds in his chest and chased down Miller who had left in a pickup truck. Officers were told Carson and his girlfriend Sara Delsavo had been arguing and Miller told them to stop it.

Miller has claimed self defense from the beginning.

He said Carson came at him with a knife in his hand, but Delsavo said her boyfriend was unarmed, according to charging documents.

Among the further work to be done mentioned this morning was the defense getting an expert to review the autopsy findings regarding gun powder residue and the proximity of the two men to each other.

The trial has been repeatedly pushed into the future as attorneys have dealt with examinations by doctors about Miller’s competence to stand trial and his mental state at the time of the shooting.

Last month the court was informed he wanted to plead not guilty by reason of insanity and a hearing was planned so a judge could hear from experts on both sides. It’s cancelled.

Miller is also charged with several counts of second-degree unlawful possession of a firearm as detectives say when they searched his home, they found a a MAC-10 semi-automatic and four other guns.

Miller’s previous domestic violence assault means he’s prohibited from possessing firearms.

Centralia police also allegedly discovered a silencer and a bullet-proof vest in the house.

The trial, which is expected to last five days or less, is now scheduled for the week on April 15.

    Justnow. seems to me that Weston was choosing to use drugs over his daughter I am David’s sister inlaw and I can say that yes we do care that this little girl has to go through this and yes it hurts but she has her father to thank for all of this it was not David’s choice to be murdered

    jusknow……………….. david also had two kids !!!!! so what does that say about weston ???? its not ok to kill any one !!!! weston did have a little girl who will grow up with out a dad but a least she can visit and hear her dads voice again what about davids kids ?? they will never hear there dads voice again and they cannt even visit him !!!! and im sure david didnt do any thing teribble enough to be shot !!!!!!

    One thing u guys don’t care nor know about is WESTON has a child that now has to grow up with NO father and he was a wounderfull father to her.. He would have NEVER put anything else before her that includes KILLING someone that someone DAVID had to do something to him FIRST!!! And the witness needs to be thoroughly questioned about what happened if she hasn’t already!!!

    I’m gonna say it AGAIN…. WESTIN is obviously sneaky and conniving! Why call someone ” friend” and then kill him. I’m repeating this “KILL” him. That is a drastic, uncaring, unfeeling thing to do!!!!! Maybe someone should check into westins past more thoroughly, for any other missing people. This leans one way or the other…..either westin was scared to death(which I doubt, since david sara were all ready to leave anyway)…..OR … hes done this before and its NO BIG DEAL!

    Yep Brenda is right the witness is back in town. There was no self defence come on Weston do the crime do the time. The sad part is that Davids family has to do the time the rest of there life they lost apart of there life forever.Westons family still has Weston and he is alive. David is gone but trust me he will not ever be forgotten or who took his life how sad.

    weston is a COWARD !! thats why he keeps SAYING HES CRAZY AND WHEN THAT DIDNT WORK HE CHANGED HIS PLEA TO SELF DEFENSE !! THERES NO SELF DEFENSE ABOUT !!!!!

    Why would the star witness leave when she is the only witness to David being murdered? Just asking ‘disgusted’ whats your thoughts on this.
    Obvously westin is conniving, first you plead insanity and when that doesnt fly, you change the plea to self defense, KNOWING it will slow everything down and certainly hurt the prosecutors plans. Also cost Lewis Co. a whole H–l of alot more money!

    I think the star witness in this case may have skipped town as well. They’re going to have a hard time proving that it was not self defense without her testimony.
