The Associated Press reports the city of Centralia was hit with a lawsuit yesterday, challenging its stance on marijuana businesses.

An item published on Kirotv.com says a prospective pot retailer, Perry Nelson, proprietor of RIU420, sued the city in Lewis County Superior Court, saying the local moratorium is an unconstitutional ban on a legal activity.

Voters legalized recreational marijuana in 2012 and the Washington State Liquor Control Board has been issuing licenses to grow, process and sell.

    What ever happened to the Lawsuit Sharyon? Just another issue swept under the rug like usual.. Lewis County home of the last ‘Good Ol’e Boy Resort.

    Lewis county and the feds dont believe in the tenth amendment of the constitution or the second amendment. The american people are no longer in control of their government which is exactly the reason for the second amendment, it wasnt put in place so we could hunt. The founding fathers had just overthrown their government that had been in place for a hundred years or more and wanted to be sure that if things went wrong in government the people would have recourse. The tenth amendment says that if something is not prohibited by the constitution the people can decide if they want it or not so the people of washington did just that- twice and lewis county still refuses to consent to the the will of the governed- these people are treasonous bastards but they have the power. I hope this guy wins his lawsuit because according to the tenth ammendment he is absolutly right. Keep on writing sharyn u do a good job trying to be unbiased which is a rare thing in american journalism. God bless you.

    Why put any blame on a cop? The City Council makes the laws and decisions he is obligated to uphold, not the police department.

    If you don’t like the laws your local government passes then support candidates who do or run for office you’re self.

    Yes then hopefully my charges will be challenged next. This county is a joke I travel all over Washington and I see pot stores everywhere and on almost every corner. In fact there’s a pot store less than 10 miles from the Lewis County Court House on the Thurston County line. Jim Shannon give it up already, your fighting a losing war. Go after the Drunks and illegal instead. The people have spoken with their votes, Washington voters have chosen that they want Cannabis.

    Uhm, yeah. Even the FEDERAL GOVERNMENT has seem to forgotten that cannabis is ILLEGAL. Go figure!! lol

    I’m sure no matter what the outcome of the case it will be appealed. Let’s just save all the trouble and send it straight to the supream court. That way we will get an answer in a reasonable amount of time, like 4 or 5 years.

    Everyone seems to forget that marijuana is still illegal under federal law. The new laws in WA and CO will be interesting as they play out in courts.

    What a fascinating legal question this case will deal with: Is a county court obligated to force a city to violate a federal law?
    The outcome should be very interesting with other possible ramifications down the road.
