CHEHALIS – When police found a backpack containing a one-gallon freezer bag nearly filled with chards of meth and more than $11,000 worth of heroin inside a south Chehalis home in December, they didn’t have the authority to enter the house.

So say lawyers in the case of the Mauel brothers, two men arrested and charged with two counts of possession of a controlled substance with intent to deliver, as well as unlawful use of a building for drug purposes.

“There was an issue with the search warrant affidavit, which would have been extremely difficult for the state to overcome,” Lewis County Deputy Prosecutor Paul Masiello said yesterday.

Randall D. Mauel, 43, was in Lewis County Superior Court with his attorney, following a plea agreement which would send him to prison for a year and a day.

The raid that took place on Dec. 9 at the 2500 block of Jackson Highway came out of fast-moving investigation by the Thurston County Narcotics Task Force. The Lewis County Regional Crime Task Force and the Lewis County Sheriff’s Office SWAT team assisted, contributing about half of the 14 law enforcement officers that swarmed the residence.

Centralia defense attorney Don Blair told the judge a problem with the affidavit was an understatement.

Mauel pleaded guilty yesterday afternoon to two counts of drug possession, admitting he had drugs.

Lewis County Superior Court Judge Richard Brosey agreed with the recommended time, and read off a list of 16 previous felony convictions, mostly involving drugs, on the defendant’s record.

The judge was told he will be also doing two years for a Thurston County conviction that followed his March arrest in Tenino when detectives reportedly found nearly $10,000 cash in his wallet, along with a little more than an ounce of methamphetamine and a small amount of heroin.

Masiello said the case of  Ryan G. Mauel, the younger brother was resolved a few months ago, with a few months of electronic home monitoring, if he recalled correctly.

The sheriff’s office describes them both as Chehalis residents. When the brothers were charged in December, the judge was told the house belonged to their parents.

“We’re trying to get the best outcome we could possibly get,” Masiello said after the hearing.

Without the drugs available as evidence, the case essentially goes away, he said.

He explained the issue of the search warrant this way: When using an informant, they needed to establish the informant saw what they saw and that the informant was credible, he said.

When the Thurston County drug task force officer made a recorded request by phone to a judge, the officer didn’t really address the veracity part, other than saying, we’ve used this person before, he said.

Not relevant, the relevant question to ask would be “would Jesus have accepted and forgiven those who were on either one and those who supplied the addicts with both” I’m sure any one who honestly cares what Jesus did knows the answer so shut the fuc* up haters. How bout when these school shooters who are all messed up on prozac, adhd drugs, and powerful anti psychotic medication go get guns and start shooting people, can we then go after big pharma? 100% of the mass shootings in the past 20 years were perpetrated by people on these big pharma drugs.     Finally, an eye for an eye as an exacting and literal punishment came from Hammurabi’s Code in the 18th century BC. When mentioned in the Bible (Old Testament), it was as a limit on punishment after a proper trial, not for so called vigilante justice. Jewish scholars long ago interpreted to mean an equivalent punishment (like three years in prison).

    So are you saying that if he might have killed someone we should kill him? I do not follow. The drugs he sells may have cause someone to die sure, but he did not administer them to people. People make choices. I am not saying that this guy is a saint. People are so quick to pass a judgement and say someone should die. Hopefully you are never falsely accused of a crime and sentenced to death. This happens. Once again it is pretty clear there was criminal activity in this case. Clearly. But if we allow the police to operate outside of the law, the law becomes meaningless. The cops should have done things correctly. If they did the outcome of this would have been different.

The plain fact is, drug dealers are scum who are lower than used car salesmen or attorneys, lower even than congressmen.

    An eye for an eye, but this guy did not kill anyone. So I am not sure deserves to die. One thing to remember in all this is that drug dealers do not make people buy drugs from them. Two way street. Not that it makes it a good thing to do. It is just strange to me that the answer to this is to kill the guy. Someone will just take his place. I think it is short sighted.

Find all the excuses you want but the facts remain. Addiction is a disease is an opinion and in my opinion its a choice, plain and simple. You make a choice to put the pipe to your mouth, you make a choice to shoot poison into your veins, you make a choice to short powder into your sinuses. Say all the feel good excuses for addiction you want to Lurker, I’ve been around near 60 years and have at one time or another made the above choices, and eventually made the CHOICE to stop.     If I remember correctly, in 2010 the totality of value of the Fed. seizures related to drug activity doubled from 1 to 2 billion $. Shouldn’t that mean that drug activity was halved?     If you want to know the truth about addiction, find an addict and discuss it with them or check out an NA meeting. Don’t listen wholly to the parasites, they will lead you astray.

    In this case, it was the judges fault. Judges routinely grant search warrants without really exploring whether or not probable cause exists. Judges need to do a better job of questioning police, and not rubber stamp warrant requests.

The only thing that may change a turd like this is a lengthy prison sentence, 10+ years, personally I don’t want to pay taxes toward warehousing scum like this, a bullet, length of rope or lethal injection is much cheaper with a guaranteed result.     More people need to realize that we all are capable of illegal , and immoral things. Some of us are guilty of things far worse than this man, and although we all need to be held responsible and pay our debt to society;let’s try and remember to have compassion for our fellow man. He may be seen in the eye’s of society as a threat, but there’s a flip side… He’s also a victim, a victim of addiction. When a person uses drugs it is their choice, Randy didn’t make them. I guess what I am trying to say is, I chose not see this as a reason for celebrating another worthless, scumbag being taken off the streets , but a blessing because people can change and everyone of us deserves to be given a chance to make it right.
