Centralia police officer asks judge to order citizen to stop harassing him

CHEHALIS – A Centralia police officer is seeking an anti-harassment order against a 20-year-old local man, who has been calling him crooked and corrupt on social media.

“He posted pictures of my family on Instagram, after he posted I should be executed,” Officer Michael Lowrey said.

“I think he’s taken it too far.”

Twenty-year-old Bo D. Rupert is currently prohibited from contacting Lowrey or Lowrey’s four children, based on a temporary court order put in place last month.

The two men have gone before a judge in Lewis County DIstrict Court twice, but an anti-harassment hearing has not yet been conducted because Rupert requested the two different judges remove themselves from the case.

Rupert contends Lowrey has, while on duty, taken part in stopping him from videotaping public employees, unlawfully demanded his identification, and on various occasions when their paths have crossed in public, called him vulgar names.

The final straw, according to Rupert, was a day in which he claims Lowrey got a teenager banned from a local business, after the teen told the officer he wanted to speak with his uncle, and said his uncle was Rupert.

“Pretty much I had all I was going to take off him, after that,” Rupert said. “My pictures on Instagram and the amount of worry it made him feel, measured up to nothing compared to how I felt about my nephew.”

Lowrey, who has been a Centralia police officer for about 15 years, is making the request as a private citizen, his lawyer Shane O’Rourke said after the most recent hearing, held Monday morning in Lewis County District Court in Chehalis.

O’Rourke said his client is aware that as a public servant, he has to tolerate a certain level of unpleasantness from some members of the public.

“Mr. Rupert is well known for engaging in a particular type of behavior,” he said. “His attempts to antagonize go beyond what you deal with on a day to day basis.”

O’Rourke said police officers are still, first and foremost, citizens and don’t have to be subjected to that.

It is a rare and unusual occurrence, as far as he’s aware, O’Rourke said, for a police officer to ask for such a court order.

The temporary order allows for contact between the two for legitimate police business, he said.

Court documents show the 42-year-old officer made the formal request on Feb. 13. A temporary order was put in place the same day, but did not require Rupert to stay 1,000 feet away, as requested.

Lowrey checked boxes on the petition for order for protection from harassment and stalking form indicating Rupert’s ongoing behavior caused him to feel seriously alarmed, annoyed or emotional distressed.

Lowrey said on Monday it’s not getting videotaped on the job that’s bothering him. He wrote in his request that with the current backlash against law enforcement, he believes it endangers his family when Rupert posts photos of him, off duty, with his young daughter, along with comments that he is corrupt.

In a declaration in support of Lowrey’s petition, Centralia police Sgt. Stacy Denham writes that in his career of more than 20 years, he’s dealt with all kinds of individuals who don’t like police, and go  out of their way to discredit officers simply for entertainment.

“All of these individuals pale in comparison to Bo Rupert,” Denham writes.

He notes Rupert’s numerous convictions for false reporting, calling it an incredible addiction to trying to get others in trouble. He writes that Rupert’s new means of attack is to follow officers around and videotape them, berating them with profanities in an attempt to get a rise out of them.

Denham described Rupert’s activities as escalating into yelling at Centralia Police Department staff through the glass and calling all officers inside a laundry list of unacceptable slurs.

Among the screenshots from social media in the petition is a Facebook post by Rupert in which he wrote:

“The police must be returned to their original purpose to protect and serve WE THE PEOPLE, any that are not and refuse to do so should be executed for treason!!!!!!! Starting with Mike Lowrey, Sgt. Stacey Denham, and Phillip Reynolds”

Rupert, who said he lives part time in Chehalis and part time in Centralia, says he’s a volunteer for a police accountability group called “Peaceful Streets Lewis County”,  the local chapter of a national organization which video records police officers and other government employees while they perform their public duties.

In his general affidavit submitted in response to the case, Rupert writes that he usually picks two nights each week to film, listens for calls over a police radio scanner and arrives on scene staying a safe distance away. He states he also often advises people of their rights and records the interactions.

He claims in writing an instance outside the Centralia library in which Lowrey called him a name, stepped out of his patrol car and said if there were not people around, he would “kick his (blank) ass.”

“It was that moment when I decided from then on I was going to expose his corruption and the content of his character,” Rupert wrote.

In an interview after Monday’s hearing, Rupert acknowledged the Facebook post, paraphrasing it from memory to say, “I wrote to a Facebook status ‘Treasonous officers who create insurrection against the constitution should be executed,’ and I named the officers doing that.”

“I never said I was gonna pickup a gun and shoot Officer Lowrey,” he said.

Rupert said if Lowrey is successful in getting the temporary order made more permanent, he will appeal, because it could have other consequences.

“You can bet I’m not going to let someone use the court system, the legal system, to abuse and oppress people,” he said.

The anti-harassment order hearing is scheduled for March 30, when a pro-tem judge both sides agree upon is to be brought in.

Meanwhile “criminal thugs” and “tweekers” catch the bad wrap on the sirens and in the chronical in general due to censorship. When will mike and the others be called to justice for their crimes.     In all fairness “Free Air” (Ironic that you call yourself Free Air in the country that locks up more of it’s citizens than any other country in the world for non-violent and victimless crimes), the post you compared to an “ISIS recruiting video” (which I’m sure you spend most of your time watching them on YouTube), is more similar to the writings of Thomas Paine or Benjamin Franklin. But I wouldn’t expect you to know who those people are or what their writing styles were like. Afterall, you’re too busy fighting ISIS and watching ‘recruiting videos’. I am just in aw at the way you are handling yourself while dealing with this Gang of Police Criminals.     Bo will be 21 in a few days. He has never held a job. He has always bummed off of his friends. He thinks he is going to get his gun rights back, he thinks he is gong to be a state senator. He is on food stamps and SSI for his eye. Every time something happens he use’s his eye for a excuse. But he goes around and harasses the cops and don’t what their flashlights on him at night time. His troubles are just starting with harassment orders. I hope when he turns 21 he see more of the inside of grey bar hotels. He has stated he wanted to be just like someone else that was shot and killed here in Centralia. The person is his hero after he read about him. He even lived with the person’s family to find out what he could about him.

    In a land far far a way (Centralia) There was a officer know for his abusive traits and his physical size that was terminated and reinstated more times than I can remember in the 80’s.
    No one ever acted the way Bo has, in the past in our community. I will predict that with his ambitions it wouldn’t surprise me if his next tactic weren’t to test the open carry law of our state while interacting aggressively towards our officers. That would finish what might be his life long ambition to get shot by one of our officers.
    The good news there would be that we might be heading off a generational crime family problem if he were shot, prior to reproduction. The bad news is that some officer might have to live with having shot an idiot with the charge being stupidity. It’s a toss up.
    I have life long friends who wear the badge, it’s a tough job, there are good officers and bad ones. I don’t know anything of this officer, so I can’t speak of him. But involving an officers family has some inherent risks that Bo might not be able collect on after his will is being probated.
    It should be remembered that a jury in this county will fairly represent the demographics of our society to say “what would your Grandmother say if she were sitting on a jury reviewing Bo’s actions” or a coroner’s inquest or a law suit filed after he gets shot.
    Maybe he should just get a job, and grow up.

THe officer has every right to protect his own, and it sounds like this guy is going of the deep end one step at at time !     I have no idea what twisted definition of “fine and outstanding” could possibly be applied to someone who threatens kids and a wife; which is what Bo ended up doing.

    This whole thing reminds me of a slow motion train wreck. You see it building up and hope that somehow nobody gets hurt, yet the train keeps coming despite all the warnings to stop. I can only hope Bo’s passion for being a professional victim does not push him to do something violent against a first responder.

    Where I a Centralia Cop, I’d be nervous as a cat around anyone who gets a kick out of forcing confrontations. This is starting to sound more like a Martyr complex than simply a concerned citizen overstepping decency for his own kicks.

    Hasn’t little Lowry heard of freedom of speech. He has harassed his share of people, trust me. It’s hilarious the tables have been turned and he cannot handle it. I agree, leave his family out of it. They have not harassed anyone, but certainly Mike knows he has pulled people over for absolutely no reason which is called profiling. And if there truly was justice, he would already have lost his job.

    bo rupert is stupid enough to allow himself to be used by others who put him up to these things. most people can’t stand to be around him even. every time he goes to jail they have to figure out where they can house him. if they try to put him in general population the other inmates will injure him. even inmates can’t stand the dude. he has a fake eye that he takes out. when i was a trustee one time he took his eye out and held it up on the shoulder of another inmate when the guy saw it and turned rupert said real loud “i’ve got my eye on you” they had to move him again. there must be a hole in the ground someplace looking for a new occupant.

    I agree. Videotaping from a safe distance should be okay since if officers re acting professional they have nothing to fear of being recorded. But knowing how these interactions go Mr. Rupert does not stop there. He goads officers and yells out across to teh interactions. If an officer should turn his attention Mr. Rupert for one second the suspect has a brief advantage time to do something to injure an officer.

    Posting pictures of officers children on the web is way overboard and has nothing to do with how an officer is acting.

    Mr. Rupert is 20…still a kid and hopefully time to learn.

    It’s one thing to be a watchdog recording interactions between police and the public to ensure the public’s rights aren’t violated. I don’t have a problem with that as long as the watchdogs don’t involve themselves directly in that interaction. We’re all aware that not all cops are going to act honestly and respectfully to private citizens. Got that.

    On the other hand, how does posting pictures of an officer’s children online promote greater accountability from law enforcement? How does trying to goad cops into an on-camera confrontation serve any of us? Mr. Rupert has not just crossed the line between genuine public watchdog and attention-seeking provocateur, he’s obliterated it.

    I’m in no position to comment on Officer Lowrey’s fitness as a policeman but I don’t blame him for wanting to protect himself and his family from this sort of public abuse on social media.

    I agree with you both Free Air and GoodGrief! What a waste of our taxpayer dollars and our valuable resources. Ruperts antics have only proven one thing to me with the few recordings I have seen…our law enforcement officers show a tremendous amount of restraint with dealing with mentally ill members of our community. Also, he wastes so much of the officers time with frivolous actions that he could actually be preventing citizens with legitimate complaints & emergencies from getting help they need. He needs a judicial reminder to respect the RIGHTS of that officer and his family. …and he “advises” others of their rights?? What bar did he pass to give legal advice??

    Free speech and rights against illegal search and seizure are not helped by this sort of behavior. I hope the judge will put some boundaries around this so others are not attracted to the same tactics.
