Prosecutor: Vader couple broke their agreement to tell truth about toddler death

CHEHALIS – The Lewis County prosecutor is claiming a Vader couple didn’t hold up their end of the deal in a plea agreement that allowed them to admit to manslaughter instead of facing a more serious charge, but wants them to be sentenced for manslaughter anyhow, and face much more prison time.

Danny and Brenda Wing, both 27, have both been held in the Lewis County Jail since their arrest late last year in the death of  3-year-old Jasper Henderling-Warner who was living with their family.

Each of the two have pleaded guilty to first-degree manslaughter and third-degree child assault. In exchange for prosecutors dropping a charge of homicide by abuse, the couple promised to share information with authorities and undergo polygraph examinations.

Jasper died last Oct. 5. from what the coroner labeled chronic battered child syndrome. His 21-year-old mother had given the couple temporary custody last summer while she was homeless and looked for work out of state.

Prosecutors filed motions last Friday, and Monday, asking the court to find the Wings violated the plea agreement and the state wants to make sure the agreement is enforced. Prosecutors want to add back into the case so-called enhancements and seek exceptional sentences.

Had the Wings done what they said they would, prosecutors agreed they would face standard sentencing ranges of between 146 months and 194 months in prison.

Lewis County Prosecutor Jonathan Meyer said Brenda Wing admitted some information she gave was a lie. And her husband withheld information in three of four areas, he said.

The idea was for prosecutors to find out the details of Jasper’s death, so they could hold everyone accountable who needed to be held accountable, Meyer said today.

The Wings were initially charged on Nov. 7 with homicide by abuse or, in the alternative, first-degree manslaughter, two crimes with widely different penalties. Each of the two were charged as either the principal or accomplice.

Their sentencing hearings are currently on the court schedule for tomorrow, in Lewis County Superior Court, at 9 a.m. for him and 1:30 p.m. for her.

Brenda Wing’s lawyer John Crowley has asked for the hearing to be postponed. Yesterday, prosecutors filed a response to the defense motion.

    Wow thanks for that reply spotted. I had always pictured prison as being worse than jail. You are never to old to learn something new.

    PS I do not want to be in either jail or prison just so you know ha ha

    Bobby in LC….as a former corrections officer for the state of Wa I can assure you that Lewis Co Jail is A LOT harder to deal with life in than the state prison system. In the state prison system, inmates regularly get out of their cells to attend school, yard, watch tv in the day rooms, church, go to various jobs around the prison facility, go to the mess hall, rec., etc. Even medium security it is more like a controlled boarding school than jail. In jail, you are confined to your cell and maybe a small dayroom if you behave. Your living conditions in your jail cell are like IMU or maximum security in the prison system. In prison, excluding maximum security and death row, you have a lot more freedom to move around and socialize with others as well as participate in activities to better yourself and fight boredom. In jail, you are as bored as hell day after day after day. For the Wing nuts- Danny the slimeball and whatever the cold hearted bitch’s name is, prison is a VAST improvement in the quality of life vs. the county jail!! I would much rather see the 2 pond sucking scum bags STAY IN COUNTY FOREVER because it is definitely a much worse place to be than prison and as long as they are in county, the locals that end up in jail KNOW WHO THEY ARE AND WHAT THEY DID and their health and well being is definitely in a potentially compromised state of being. I have heard several people I know make the comment about doing something rash just to end up in jail with them…. just my 2 cents

    Reinstate the homicide by abuse charge, and put them in jail until they are in they’re at least in their 60s or 70s so they can’t have any more kids; and should never be allowed around children again period. I also don’t have anything but disrespect for Jasper’s baby daddy. No mercy; both thumbs down.

    Lied about what they did for a plea deal? Big surprise. Okay time to sentence them so they can be transferred to a state prison and get them out of county lock up. I know life without parole isn’t an option under current statutes but pile on enough years with the enhancements to make it the same length of time.

    Of course the defense has asked for the sentencing to be postponed. There has to be a limit of how much time the defense gets. I know scumbags have constitutional rights but the whole speedy trial thing is over, they were party to a pleas deal requiring them to be truthful (that went well) and know it is time to start serving their sentences in prison.

    Jasper certainly didn’t have anyone standing up to protect his rights. The two biological parents could not even come together to decide on a funeral home making the coroner hold Jasper for months until judge could intervene.

    Seems Jasper, the true victim in all of this, is almost forgotten in the whole court process.

    I am the biggest supporter of constitutional rights but they have had them all protected. Time to hear that cell door swing shut and lock behind them in prison and get them out of the “softer” conditions of the county jail.

    Rip lil man we will always love u and u will never be fprgoten im so sorry you suffered the way you did as far as your mom she failed u i know she loved u and u loved her but she let the drugs take control of her and thats where she failed shw needs to be.locked up also why does she get to go on as you lay cold and beaten to death i hope they all rot in hell and be tortured with what the.three of thw did tell the day they die

    Gee imagine that , these animals made a promise and broke it . What to do ??? What a joke, the state should lock them up for ever , or better yet give them the same deal they gave that child. There should be no mercy for that which destroys innocence . Also the Mother of this child should face some reckoning too.

    His biological parents need to be charged also as they allowed this to happen. May they all four burn in hell.
