Court hearing reveals more details about Salkum triple slaying

CHEHALIS – For the first and maybe the only time, a courtroom of spectators this week got to hear Ryan J. McCarthy’s description of what happened inside a single-story house on Wings Way very early on the morning of August 21, 2010.

After he and John Booth Jr left, three people including a teenage boy were dead, and a woman lay on the kitchen floor bleeding, all from gun shots to their heads.

McCarthy, now 30, was sentenced this week for his role in last summer’s events in the Salkum-Onalaska area home.

Late last summer, prosecutors charged both men with all three murders, saying it didn’t matter which one pulled the trigger.

Lewis County Chief Criminal Deputy Prosecutor Brad Meagher told a judge in court earlier this month that Booth fired the shots and “Mr. McCarthy was there.”

On Wednesday, as McCarthy appeared in Lewis County Superior Court in Chehalis for sentencing following a plea agreement, his lawyer said that was pretty much the extent of his client’s role, he was present.

Olympia defense attorney Rick Cordes told the court McCarthy didn’t commit the crimes he was charged with, the crimes he pleaded guilty to, or the crimes he was being sentenced for.

“If he was guilty of anything, it’s because he didn’t choose his friends right, who to be loyal to,” Cordes said.

McCarthy and former Onalaska resident Booth were both picked up and jailed after the shooting deaths of  David West Sr. 52, his son David West Jr., 16, and a friend Tony E. Williams, 50, of Randle. Denise Salts, then 51, who also lived at the house, survived a gunshot wound to her face.

McCarthy had just been released from prison less than a month earlier. The Redmond resident and Booth were former cell mates.

From the beginning, authorities have been saying the men’s visit to the house was related to some kind of debt collection and gun fire broke out when West Sr. brought out a shotgun and told them to get out of his house.

Cordes told the judge Wednesday afternoon that when West. Sr. said that – “You two m***** f****** get up and get out of here,” that’s what McCarthy did.

“He pushed his chair back, got up from the table and ran outside,” Cordes said. “He was outside when he heard shots fired.”

Cordes said McCarthy ran back in, but turned and left and was outside when a final shot was fired.

“He didn’t touch anybody, he didn’t shoot anybody,” Cordes said.

And he passed a lie detector test that confirmed his story, according to Cordes.

Cordes said his client entered into the plea agreement because nobody knows what  jury will do, and he faced the possibility of life in prison if he were convicted.

“The fact that he’s getting 14 years is a black eye on the criminal justice system,” he said.

Prosecutor Meagher didn’t offer the court on Wednesday his reasoning for plea bargaining, but Judge Richard Brosey spoke of what he supposed was a concern prosecutors had about going to trial.

“One problem, it’s not a crime just to be there,” Brosey said. “The state would have to show a person did something to facilitate the crime.”

McCarthy pleaded guilty three weeks ago, per the plea agreement, to first-degree robbery, first-degree burglary and attempted extortion

He did so under doctrines under which he pleaded guilty to crimes he did not commit to escape consequences of more serious charges, and agreed  if a jury heard and believed the state’s evidence, he would likely be found guilty.

When family members and one victim addressed the court before the sentence was actually handed down, it was clear they didn’t care authorities were no longer accusing McCarthy of murder.

Dan Williams, brother of Tony Williams, raised his voice and demanded McCarthy look at him as he spoke to the court.

“I lost my brother, my best friend,” he said. “You knew what was going on.”

A woman who identified herself only as “Dee” read a statement which spoke of savage animals of society and called for “an eye for an eye”.

“Dee” spoke of having to explain to Tony Williams’ 13-year-old son there are bad people in the world.

“Even life without parole is too good,” she said.

Jodi Porter traveled from her home in Eastern Washington to tell how the death of her teenage son, David West Jr., has affected her family.

“My granddaughter has nightmares about bad people coming in and killing her whole family,” Porter said. “I want justice to be served.”

When Judge Brosey spoke to McCarthy, sentencing him to 14 years plus three months in prison, he called the events of Aug. 21 a total waste, with three people who are dead, and not coming back.

“Most glaring and most disgusting is, none of this needed to happen,” Brosey said. “There’s no reason to be playing this game of going out and collecting money.”

Extorting money involves risk, and this nonsense needs to stop, Brosey said.

“If you choose to associate with people such as Mr. (Robert) Russell and Mr. Booth, you pay the consequences,” Brosey said.

The judge noted the defendant insisted he was no more than a “co-attendee”, but added since there will be no trial, “we’ll never know the truth.”

The one member of the household who survived, Salts, was not satisfied with the plea agreement, saying it’s as though the system has forgotten three people died.

Salts addressed McCarthy directly, presumably her first opportunity since he and Booth were inside her home 13 months ago.

“What you have done is taken away something that is a part of my life,” Salts said. “Dave, his son, my best friend.”

“I’ve got so much anger for you right now, I can’ even begin to tell you,” she said.

“You’re just a waste of time, of space,” Salts said. “Do you have any remorse? Are you not sorry?”

McCarthy hesitated, but finally responded to her repeated direct questioning.

“The truth is, I didn’t do nothing,” McCarthy said.

“The truth is, you were there,” Salts said.

“Every day I miss my best friend, Dave,” Salts said. “They might as well have taken mine (life) too,” she said.

McCarthy was transferred out of the Lewis County Jail yesterday, to prison.

His attorney has said McCarthy will not testify against Booth, or anybody.

Booth’s trial is scheduled for the beginning of November.

    “D.J’s couson”, drugs harms a LOT more than just the ones using, dealing, or making them. It harms those all around them. It causes deaths, not only from those who overdose, but from murders, robberies, and various other violent crimes associated with the people who use, deal, and make. It is not just “ilegal because of lobbyists and bigots” (your words), but it is illegal simply because of the damage it causes. Not only to the users, but to those around them. Violent crimes are “normal” for many of those people. And do they care if they leave innocent victims in their wake? No, they don’t. None of them do.

    Your attitude towards the drugs (or at least what one could gather from your words) would be considered “enabling” words. Put the blame where it belongs: on the drugs, and on those who either use them, deal them, or make them. The only innocent one here is the 16-year-old who was brutally executed by an animal.

    It’s a crying shame that booth and mcarthy didn’t get the death penalty, to hear them both begging for their lives would be music to my ears, the fact dave sr. may have ben doing drugs is irrelevent, drugs is only harming theyself not everyone else, and it’s only ilegal because of lobbyists and bigots. mcarthy is an idiot and he will learn the hardway after losing the best years he could’ve had with his little kid growing up. and as far as booth is concerned people like him needs to be nuetered so he does’nt father anymore would be potential morons like him, it would be reversing human evolution. seriously why even hang on the next man’s nuts. he is nothing but a little bitch just like mcarthy.

    Sharyn,I am sorry for my crude language,just tired of all these comments from ppl who didn’t even know my family and the ones who did and are trying to put up a front..There were many ppl to blame for this tragedy but not one of them being D.J…I could blame my uncle first and formost,he should have never been doing these things but hes dead now..No one knows the guilt and pain that my family feels everyday for not having known the things that were happening..We could have saved D.J..He was the baby of our family,my sons age..That child had more talent and potential in his pinky than most have in their whole body and his life was taken from him…Simply not fair!My family does appreciate your site,it keeps us updated on this case,for those of us who cannot be there at trial.

The local jail has a revolving door policy, from what I can see.. And they need some cops WITHOUT LOCAL TIES come in and do a clean up..

I think theres something wrong when people need protection FROM the government. Way fucking wrong.
    We all want our County to be a place we are not afraid to raise our children in right? A non corrupt government would be a good place to start, in fact, it should be expected. How can we make our county a place to be proud of if it is run by a corrupt government? I think its like fighting a losing battle.
    If the people didnt have to protect themselves from the government , they would fight with the government, and together this might one day be a safe, decent place to call home.

    The charges against you have been “Dismissed, WITH PREJUDICE”. This means that they CAN come after you at a later date. Will they? Maybe, and maybe not. That is up to the proper authorities.

    However, the way you are throwing the name of another person around, would not that be considered slander as well? Simply by releasing your name in a news report to the media, law enforcement has not slandered you, and the media has not slandered you either.

    And yes, it IS up to you to prove that you are not who the authorities alleged that you are/were. Your actions and words DO speak volumes about the person you are. So again I ask: Are you being honest with yourself?

    Well George, I am innocent along with the 2 others that Katie Johnson used and set up to work her deal, as she continued to rob, and steal. Charges have been dissmissed on all of us. If they are working a case against us, then first they have to have a case to work. I dont plan on clearing my name, i AM NOT THE ONE THAT SLANDERED MYSELF.

    Dismissed “without prejudice”. This means that they can come after you at a later date if they so desire. It might even mean that they are working on building a stronger case against you. It could also mean that they just don’t have enough to try you in front of a jury with a 100% chance of conviction. But then again, it could even mean that you are, indeed, innocent. Does this mean you ARE innocent of the original charges they filed against you? It’s for you to decide for yourself, and you might want to be honest with yourself.

    As for the local newspaper, or ANY news outlet for that matter, printing information about your arrest for whatever alleged crimes you may or may not have committed, once that information has been released by the relevant law enforcement agency, it becomes a matter of public record.

    As for stating that the Chronicle is defaming your character and slandering your names, by your words concerning the alleged “CI” (Confidential Informant), wouldn’t that be considered the same thing?

    And as for your little bit about methamphetamine, you could not be more wrong. The drug itself might not kill, but the chemicals used to manufacture it do. These are chemicals better suited for being rat poison or industrial strength cleaners. And then, after these chemicals have turned your brains into tapioca, there is all the other stuff that can (and does) kill the user. To say that meth doesn’t kill, well, it does.

    About the only thing you have said that makes any sense is concerning the travesty of justice in McCarthy only getting 14 years for his role in the brutal execution of three people. For that, the voters SHOULD take a good look at the judge and the prosecutor for even considering the deal.

    So, as for clearing your name, actions speak volumes… I wish you luck in doing so.

    Janet, I have been on both sides of the fence. I lived on the “streets” long before a lot of you were even born! 🙂
    However, I wasn’t into the drug scene but many People I knew were. Back then there wasn’t METH and people didn’t die over “old school” drugs like they do now. It scares the crap out of me for our young people today. My niece is 20, lives in this county, and I pray to God she never gets mixed up with any of these kinds of people.
    I have no sympathy for career criminals who claim to be mixed up in the wrong crowd argument. It’s a choice. If McCarthy is worried about being labled a snitch now, it’s only to save his ass in prison. He could have been on the receiving end of the gun if he was a snitch on the street. An honest person who reports crimes instead of turning the other way isn’t a snitch, they’re doing a duty to their community. I don’t see him fitting those shoes. He just saw a way to NOT spend the rest of his life in jail.
    I don’t know how the court can sleep at night either.

    What about the known fact that if your “husband” had gone to trial, he would have been found guilty of THREE counts of First Degree Murder, which would have put him in prison for, oh, the rest of his natural life, perhaps? So the ONLY reason he took the plea deal is to save his own butt and to not have to spend the rest of his days caged like an animal. How the prosecutor who offered this and the judge who accepted it can sleep at night knowing that the cause of justice was not served is beyond me, especially considering that the attorney for your “husband” says he won’t testify against Booth, or anyone.

    Justice was NOT served. The people who were elected to serve the best interests of the LAW-ABIDING citizens of this county completely failed to do so, catering to the whims of a convicted felon who does NOT belong in society.

His trial was for this month did u ever consider that maybe he didnt do anything that the evidence was the best for the prosecuter?     No one in that house was innocent. Even though i know a lot about this tragedy, even more than has been released to the newspapers and news stations, everyone in that house that night was guilty of something, including David West Jr., but that doesn’t mean that any one of them had to die. I completely agree with what both Cleaver and George had to say. I live out here because I like the small town life, and i want a good town environment for my kids to live in. things like this will not be tolerated. we are good people that like ou small town and dont want those kinds of people in it.
    I dont know McCarthy, but i went to school with John Booth, and i know that all of us that know him were utterly shocked to hear that he is accused of doing this. I don’t know if he did it or not, but the John Booth i remember from high school wasn’t capable of this violent act. If he is found guilty, he’ll get what he deserves. One way or another. And i think the Lewis County Justice system seriously failed us with the way they handled McCarthy. Come November we will hopefully know the truth about why this happened when booth goes to trial. And as far as im concerned, that low life scum drug dealer robbie russle is just as guilty and as responsible for what happened that night, his hands are just as dirty. Innocent or guilty, Booth will face a jury and let them decide. and Salts and her family can spout off whatever they want, no one with half a brain would ever believe a word that woman says.

    Sarah, you might want to have your facts clear before you start spewing your “oh, she is so innocent” nonsense.

    Your “mother” HAS been to court for her case concerning drugs earlier this year, this much is true. But the reason she is not in jail for that is because she is free on bond (posted 6/18/2011), and is currently awaiting trial (scheduled for the week of 12/19/2011). So, her case has not been adjudicated yet, and unless there are further delays to her trial, then some time during the week of 12/19/2011, a jury of her peers will hear the facts and determine her guilt or innocence.

    As for the whole “the drugs were just in the house that she was staying in…”, perhaps you can shed some light on why she is the only one that was taken to jail? Why are there no others from that house in jail, or awaiting trial? If I’m staying somewhere, I would know if they had drugs there, and would make sure that I wasn’t there for any longer than it would take to say “I’m outa here… I don’t need that stuff around me…”

    And remember: If it walks like a duck, and sounds like a duck, then it is most likely a…. well, I’ll let you figure it out.

    That “Salts chick” is my mother. She has to been to court for the reason she got arrested. She didn’t go to jail, want to know why? Because they weren’t her drugs, they were just in the house that she was living in. And Robbie had these people collecting money from my mom and step dad because he went to court and testified against Robbie. It was Robbie’s last strike and he knew he was going away for life if Dave did that. That’s why my family, and friend got killed and hurt.

    Well, just gotta say this. people read the paper, and us Lewis County folk aren’t as stupid as everyone thinks! This whole thing was all about drugs. people in their 40’s and 50’s selling and doing drugs. This Salts chick was just in the paper again a cpl. months ago with drug charges. I feel very bad for the 16 yr old. As for the rest…YOU LIVE BY THE GUN, YOU DIE BY THE GUN. That’s the way of the crime world.
