Jones, 28, of Toledo, were found a couple of hours later walking along Pear Street and booked into the Lewis County Jail first-degree burglary, according to the Centralia Police Department.

I have to agree with George. I think a very important part is the charge “possession WITH THE INTENT TO DELIVER”. A medical marijuana card does not give you the right to sell it.

  2. George says:

A few questions: Is it “Reid”, or is it “Reis”? You used both of them….

A “medical marijuana card” does not prevent police from apprehending a person in possession of marijuana. It CAN help get any charges dismissed, as long as the card is issued for a legitimate medical condition. However if you have a quantity that can be considered above and beyond “personal consumption”, then you pretty much have to deal with that. Are the charges false? Did you indeed have more marijuana than you would need for “personal consumption”?

The reason you were not “arrested and booked” is because you were “arrested and then released”. Just because a cop doesn’t take you down to the jail does NOT mean that you were not arrested.

As for the actions of the cops, if they did indeed barge into your house with no search warrant, then you might have a case. You say they didn’t knock… perhaps they had a search warrant due to probable cause, and came right on in without waiting for you to destroy any evidence that could be used? Ever watch that TV show “C O P S”?

And you can’t sue people for “slander” when they are reporting based on data released to them by the appropriate law enforcement agencies. Sorry, but that’s one case that would get thrown out before it even made it to court.

Just because you are angry that they busted you for possession of marijuana with intent to deliver doesn’t give you automatic grounds to rant about how they came after you “for no reason”. They most likely had a very valid reason for doing what they did, and it will be something for the courts to decide.
